Focus Graphite faces $450k legal claim from its former President and current CEO of Alabama Graphite

Focus Graphite announced on Wednesday that its former President and COO, Don Baxter, has filed a $450,000 claim against the company for wrongful dismissal. Baxter is currently CEO of Alabama Graphite.

According to Focus, Don Baxter is seeking damages for “breach of contract, wrongful dismissal and punitive damages.”

In a press release, the firm said it denied all allegations made by Don Baxter and that the action “was without merit.” Focus said the company would “vigorously defend itself against the claim.”

The company also said it was considering taking action to “protect its rights and reputation, including seeking damages.” This may signal that Focus will file a counterclaim against its former employee.

Don Baxter left Focus Graphite due to a “significant divergence of vision” and joined the flake graphite explorer, Alabama Graphite, in June 2015 as CEO.
